Chapter 7 Bankruptcy

When you file a petition under Chapter 7, you are asking the courts to discharge your debts. Chapter 7 allows you to eliminate your debts in exchange for giving up property, aside from exempt property.  Less than 5% of cases require sale of any asset. 

Chapter 13 Bankruptcy

Chapter 13 bankruptcy requires you to file a plan showing how you will pay off past-due and current debts over an extended period of time. Through Chapter 13, you are allowed to keep valuable property that might be lost under Chapter 7.  Debts are paid back somewhere between 0.1% and 100% of what is owed.
